These Terms of Use (“Terms”) govern your access to and use of the Site and any related features, content, downloads, forms, promotions, and online services that link to these Terms (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

3. Eligibility
The Services are intended for a general audience and are not directed to children under 13. By using the Services, you represent that you are at least 13 years old. If you are under the age of majority in your country, you represent that you have permission from a parent or legal guardian to use the Services.

4. Changes to the Services and Terms

You agree not to:

interfere with or disrupt the Services (including hacking, scraping, or introducing malware)

7. User Submissions (Contact, Press, Ambassador, Contests)
The Services may allow you to submit information or materials (e.g., messages, press inquiries, applications, contest entries, photos, videos, or other materials) (“Submissions”).
By providing a Submission, you represent that:

you have the right to provide it, and it does not violate any law or third-party rights; and
it is accurate to the best of your knowledge.

Unless otherwise stated in specific contest/ambassador rules, you grant Westside Studios a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, perform, adapt, modify, and create derivative works from your Submission for purposes related to operating, promoting, marketing, and improving the Services, and promoting THE TRAIN and related projects—subject to applicable law and our Privacy Policy.
We are not obligated to review, publish, or keep any Submission confidential, and we may remove Submissions at any time.
Unsolicited Ideas: Please do not send us unsolicited creative ideas, scripts, treatments, or concepts. If you do, you agree that we may use similar ideas without compensation or obligation to you, to the extent permitted by law.

8. Ticket Sales, Merchandise, and Donations
The Services may allow you to purchase tickets, merchandise, or make donations. These transactions may be processed through third-party providers (e.g., payment processors, ticketing platforms, merch fulfillment partners). Additional terms from those providers may apply.

Payments: Payment details are typically handled by third-party processors; we generally do not store full payment card details.
Orders / Fulfillment: Delivery times, shipping costs, taxes, and customs duties (if applicable) may vary and may be handled by partners.
Refunds / Returns: Refunds, returns, exchanges, and chargebacks are subject to the applicable checkout terms and any posted policies (and, where applicable, mandatory consumer protection laws).
Donations: Unless stated otherwise at checkout, donations are generally non-refundable to the extent permitted by law.

We reserve the right to refuse, cancel, or limit transactions where permitted by law (for example, suspected fraud or errors).

The Services may include links to third-party websites, social media platforms, or embedded tools (e.g., YouTube/Vimeo embeds, Meta/TikTok features). To the maximum extent permitted by law, Westside Studios (and its officers, directors, employees, contractors, and partners) will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Services.
To the extent liability cannot be excluded under applicable law, our liability will be limited to the minimum permitted by law.

12. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Westside Studios and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your Submissions, or your violation of these Terms or any third-party rights.

13. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or if required for security, legal, or operational reasons. Sections that by their nature should survive termination will survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law).

14. Governing Law and Venue
These Terms are governed by the laws of Austria, excluding its conflict-of-law rules. Any disputes arising out of or related to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts in Vienna, Austria, unless mandatory consumer protection laws provide otherwise.

15. Miscellaneous

Severability: If any provision is found unenforceable, the remainder remains in effect.
No Waiver: Our failure to enforce a provision is not a waiver.
Assignment: We may assign these Terms as part of a corporate transaction; you may not assign them without our consent.
Entire Agreement: These Terms (and any policies linked from them) form the entire agreement regarding your use of the Services.
